Terms and Conditions

Villa Booking.

The villa booked as per the booking form on New Koh Chang Villas website is the villa that you will stay in. No changes on arrival can be made unless by prior arrangement. Any changes will incur additional charges as per the website rates.

Booking Deposit

A booking deposit of 25% is required on receipt of confirmed availability by email; this is to be paid within 48 hours to guarantee your reservation and a copy of the bank transfer emailed to us. If payment is not received, except by prior arrangement, we reserve the right to re-let the reserved dates offered.

The number of persons listed on the booking schedule is the only amount of occupants allowed to reside at any villa. Further persons found to be occupying the property will be charged per night at the advertised rate on our website for that particular villa daily rate and season divided by the amount of persons residing at the villa by the owner or on-site agent.

Failure to pay this fee by the additional guest or group leader straight away, as stated above, will result in the additional guest being asked to leave the premises.

Payment

Our payment terms are a 25% Booking Deposit as described above.

Six weeks prior to your booking arrival date, the remaining 75% of the villa booking is payable.

As stated under Booking Deposit above, the 25% initial payment is due within 48 hours of making a confirmed booking.

If we have not received an email copy of confirmation of the booking deposit payment with the 48 hours, New Koh Chang villas reserves the right to open the booking dates up on our website calenders.

Refundable Security Deposit

Please refer to each individual owner’s advert for details on the security deposit amount to be collected on check-in.

The deposit will be refunded in cash and given in full upon the departure of all guests provided it is mutually agreed between the guest and the owner or agent that no damage has been caused whatsoever on the property, its contents, and grounds the villa stands on. All payments have been met and that all keys for the property have been returned to the owner or agent.

Lost or incomplete sets of keys will be charged to the guest at 1,000 Baht per set.

Any damage must be notified to the owner or agent immediately and rectified or paid for prior to departure.

Cancellation by the Guest

Please ensure you have adequate insurance cover for this eventuality.

New Koh Chang Villas Refund Policy

Our refund policy is as follows:

Booking Deposit 25% – No Refund
Cancellation 90 days or more before arrival: Refund  =75% of monies paid    excluding booking deposit
Cancellation 90 to 30 days before arrival:     Refund  =50% of monies paid    excluding booking deposit
Cancellation 30 days or less before arrival   No Refund

Please be aware that if you cancel your villa booking you will lose the 25% deposit.

 

Cancellation by New Koh Chang Villas

It is extremely unlikely this would ever be the case that we would have to cancel your booking, however New Koh Chang villas reserves the right to find you alternative accommodation similar to that booked or refund all monies paid. We cannot accept any further liability other than the above.

Occupancy

The maximum number of guests which can occupy any villa is clearly shown on the owners advert and also on the clients booking schedule unless otherwise agreed.

Additional occupancy is at the discretion of the owner and is non- negotiable.

Additional occupancy if agreed by the owner or agent will always be charged by dividing the seasonal daily rate at the time, by the maximum number of persons for which there are. Example – Seasonal Daily Rate 7,000 Thai bht = 7 guests booked = 1,000 Thai bht per day each. One additional guest is found, 7,000 divide by 8 guests =  875,00 Thai bht per day.

Children

It is the parents responsibility to take care and ensure all children are supervised at all times.

Baby-cots are available on request and subject to availability.

High chairs are also available on request and subject to availability.

Guest Obligations

The property booked is to be used solely for residential purposes.

The guests are obliged to treat the property and its contents with due care and consideration in a manner normally and socially accepted and are expected to use all items within the property, in a safe and responsible manner.

Any damage caused to the fabric of the property or its contents will be deducted from the refundable security deposit paid on check out. Damages in excess of  the said deposit will be charged at full replacement / refurbishment cost. The group leader, is solely and entirely responsible for the safety and actions of all members of the party and liable for any damages caused to the property and/or its contents.

Any damage, malicious or accidental MUST be reported IMMEDIATELY to the owner or agent.

In the event of a dispute, or where by the Police or the Thai courts are involved, the laws within the Kingdom of Thailand will apply.

Personal Safety

Neither New Koh Chang villas nor the property owners can or will accept any liability or any claim whatsoever of any nature in or outside of the property or the resort arising from any incident. All guests are strongly advised to ensure that they purchase their own travel insurance, covering personal accident, theft or loss of personal effects and comprehensive medical expenses whilst visiting Thailand.

Pets

No pets are allowed.

A fee of 10,000 Baht for professional deep cleaning will be charged to the guest should any pets, or evidence of any pets be found in the property.

Internet Access

We do provide Internet access on the resort, however it is advisable to check the owners advert to confirm.

We do not accept any responsibility, should the (ISP) lines be down or if your system /pc / laptop / phone or any other device requiring internet access not be capable of acquiring a signal.

We offer this Internet access as a free service and, should you have difficulties with the connection, please consult your Customer Care person/housekeeper.

If the problem cannot be resolved he / she will provide you with a location of some Internet Cafes which may provide a better service, but please note there may be an independent charge for their service which is outside of the responsibility of New Koh Chang villas or its owners.

Smoking

Please consider our non-smoking guests and smoke outside the property ONLY.

Smoking inside the property is strictly forbidden.

Any guest found smoking inside the property or any evidence that smoking has occurred within the property will be charged at 10,000 Baht to cover the costs of a professional deep clean.

Maid Service

Maid service is included in the price of your villa, please read the owners advert for how many times per week.

The maid service does not however include washing up of dirty crockery and cutlery, or personal washing of clothing and ironing.

Bed linen and towels are subject to the owners advert under conditions.

Extra towels can be provided if required at a laundry charge per day and extra changes of bed linen charged, per bed per time if required.

 

Water & Electricity

Please refer to each individual owner’s advert.

Please switch off your air conditioning when not required.

Liability

The owners or their agents cannot accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused. We strongly recommend our guests to take out insurance to cover this.

Force Majeure

The owners or their agents cannot accept, or be responsible for any liability, loss, damage or changes caused by Force Majeure for example: strikes, floods, closure of airports, weather conditions or any such event beyond our control.

Swimming Pools

New Koh Chang villas cannot accept any form of liability for any injury caused as a result of persons using any of the swimming pools at any villa or within the resort.

Problems or Complaints

All our villas are inspected and it is unlikely that you should experience any problems, however, in the event of any such problem occurring please notify the owner, agent or staff as soon as possible.

We will endeavor to rectify the problem immediately during normal working hours or the next working day.

No refunds or rate adjustments will be made for malfunction of air conditioners, televisions, appliances, pool equipment or any electronic or mechanical items.

In some cases 24 to 48hrs may be required to get spare parts. If any issue causes you significant discomfort we will move you to another Villa if available or use portable equipment.

Please note that Thailand is a tropical country and insects and small creature are inevitable and beyond our control. Please ensure on completion of cooking all waste foods are disposed of and work surfaces are kept clean, to help prevent insects.

Check- In / Check -Out Times

Our check – in times are  2pm and Check out 10am unless otherwise agreed with the owner.

Please abide by these times, to avoid disappointment to other guests booked to occupy the villa afterwards, as the villa needs to be fully cleaned and linen changed.
These times must be strictly adhered to, unless agreed in writing by prior arrangement.

Late Check Outs / Early Check Ins

These will be billed as an extra charge per hour.

We calculate this rate, simply by dividing the seasonal daily rate of your property by 24 and multiplying this figure by the number of full hours you wish to check in or check – out.

Early check in and late check – out are always subject to availability and cannot be guaranteed.

 

Noise

Please be aware however, that your holiday villa may be located on a private residential development with other families and children so do please respect noise levels and keep the noise to a minimum after 22.00 hrs.

Any complaints from the neighbours about unsociable noise levels after 22.00 will be dealt with, very severely and continued nuisance could result in you being asked to leave the property without a refund.
